I would like to make changes to my home, what do I need to do?There is a formal process by which to obtain the necessary approval for any exterior improvements to your home or lot. Improvements include, but are not limited to, sheds, decks, and pools. If you plan to make improvements immediately, download a copy of the Architectural Control Committee Approval Application or call our office to have a copy of this application mailed to you. The application includes a list of policy positions on common situations that might be of interest. Note that you do not have to seek approval to maintain or replace any existing approved exterior condition. For example, you don’t need approval to repaint the same color, but you would need approval for a different color. Can I file a deed restriction violation report anonymously?No. Complainants must furnish their name and address so that the WHOA has a contact person for information on the complaint. Almost all cases are resolved during the initial contact with the violator and most likely your name will remain anonymous. However, if it is necessary to go to court, witnesses will be needed to make the strongest possible case for existence of a violation and the need for correction. With that in mind, when you file the violation report, you should be prepared to testify should the case ultimately go to court. All violation complaints must be made in writing and must include your name and address. Anonymous complaints will not be accepted. You must include a description of the violation, the exact address of the violation, and the time(s) and date(s) seen. How can I get a copy of the restrictions (CCRs)?You may view or download the Declaration of Covenants, Conditions, & Restrictions (CCRs) from the CCRs webpage. Or you may order a copy of the Windermere HOA CCRs by contacting our Goodwin HOA property manager. The cost is $.500 payable to Windermere HOA. Picking up certfied letters is a hassle. Why does the WHOA send its citations via certified mail instead of first-class mail?The Texas Property Code mandates the use of certified mail in many situations, including our second-warning and fine letters. Sending certified letters is a time-consuming and costly undertaking and not the WHOA's first choice. In many cases, we send a first-warning letter via first-class mail. The first-warning letter clearly states that further citations of the same type within the next six months will be via certified mail. The homeowner is advised to avoid incurring further citations and thus can avoid the hassle of certified letters. Historically, the WHOA always sent warning letters via ordinary mail and only fine letters via certified mail. As of September 1, 2001, §209.006 of the Texas Property Code mandates use of certified mail for both our second-warning and fine letters.

How does the WHOA spend dues money?You may be interested to know that our annual WHOA dues are among the lowest in Travis County for HOAs with similar amenities. The WHOA uses the money to meet its day-to-day financial obligations, lights in common areas, landscaping and maintenance; pool guards; pool monitors, operation, maintenance, and utilities of our swimming pool, park, office; management and accounting costs; insurance expenses; non-collections- related legal fees; postage; annual meeting expenses; rules enforcement expenses; and reserve fund obligations. The existence of these activities and amenities supports the property value of every homeowner. The amount of money collected does not cover the actual amount of labor needed to run the Association. The WHOA relies heavily on the contribution of countless unpaid hours by Board members and other volunteers. If we had to rely exclusively on paid employees and contractors, the dues would need to be several times higher than they are now.

How does the WHOA handle deed restriction violations?Deed restriction violation notification and other actions of the Windermere Homeowners Association are governed by laws of the State of Texas. All actions of the WHOA must follow these laws. Once a violation is reported and the WHOA begins any of the above actions, all correspondence and other communications regarding the actions of the WHOA are confidential. When a complaint is registered with the WHOA regarding a possible deed restriction violation, the WHOA Property Manager will verify the complaint through an on-site visit to the property in question. If no deed restriction violation can be verified, this will be noted on the complaint, filed in the appropriate unit file and no further action will be taken. If a violation is present, the homeowner will receive a violation citation, which details the nature of the violation according to the deed restrictions, gives a timeline for resolution, is recorded in the permanent file of the homeowner, and is sent to the homeowner through first-class mail for first-warning letters and by certified mail for all other warning or fine notification letters (as required by state law). If the violation is not cured within the "reasonable time to cure" provided by the WHOA, the homeowner is then again notified that unless compliance is achieved by a certain time, further action may be taken by the WHOA. Violations that are not easily rectified often take months to resolve utilizing the processes that are available to the WHOA, which complies with state law. The WHOA may be able to tell you what stage any given restriction is at in the process, however, they may not be able to tell you how long until resolution, or what the next actions may be. How do I report a non-working street light?Please contact TXU with the pole number (three sets of numbers on the pole) or the address location of the street light that is out. TXU also requests that you mark the pole in some way (e.g. tie a ribbon around it) so they can spot it easily. The number to call is (888) 313-4747.

I'm not happy with the traffic on my street (too slow, too fast, not enough signs, too many signs, etc.). Who handles these issues?"The streets in Windermere are by owned and maintain the city of Pflugerville. City of Pflugerville has exclusive responsibility and authority to add, maintain, and remove traffic control signage on our streets. The city does not inform the WHOA of their actions nor the rationale for their actions. You may wish to direct your inquiry to the city of Pflugerville.
